EXECUTIVE SUMMARY:
This staff report asks the City Council to approve and authorize the City Manager to execute a Cooperative Agreement between the City of Corona and Riverside County Flood Control and Water Conservation District (District) for the design, construction, inspection, acceptance, operation and maintenance of the Bedford Canyon Channel, Stage 1 storm drain facilities and related maintenance access roads.

That the City Council:
a. Approve the Cooperative Agreement between the City of Corona and the Riverside County Flood Control and Water Conservation District for the Bedford Canyon Channel, Stage 1 storm drain facility improvement project located downstream of the Bedford Canyon Wash and upstream of APN 279-470-030 and 279-470-022.
b. Authorize the City Manager, or his designee, to execute the Cooperative Agreement between the City of Corona and the Riverside County Flood Control and Water Conservation District for the Bedford Canyon Cannel, Stage 1 storm drain facility improvement project located downstream of the Bedford Canyon Wash and upstream of APN 279-470-030 and 279-470-022.

BACKGROUND & HISTORY:
The City currently owns and operates the channel structure and abutments underneath Temescal Canyon Road Bridge and Temescal Canyon Road. The City intends to transfer the rights of certain portions of the Bedford Canyon Wash to the District by vacating easements and conveying rights-of-way. Drainage features to be included in the transfer consist of but are not limited to junction structures, concrete-lined channels, maintenance access roads, riprap, and grade control structures.
ANALYSIS:
The Bedford Canyon Channel, Stage 1 storm drain improvements are required to safely convey 100-year peak storm flows from Caltrans rights-of-way to the existing Temescal Canyon Road, and reduce erosion and sediments generated in the wash. The improvements consist of approximately 2,206 lineal feet of concrete trapezoidal channel and rock-lined trapezoidal channel with a soft-bottom invert and maintenance access roads. A portion of the Bedford Canyon Wash, upstream of Temescal Canyon Road, is to be reconstructed. The channel improvements will connect to the upstream face of Temescal Canyon Road.
The District is responsible for constructing the improvements to the channel. Upon completion of the channel improvements, the District will accept the improvements and maintain the Bedford Channel, Stage 1 improvements. The City will continue the operation and maintenance of that portion of the remaining existing City facilities related to the Temescal Canyon Bridge and roadway, relinquishing the maintenance and operations of the channel drainage facilities to the District.
The District will enter into a Conservation Easement Agreement with the Riverside-Corona Resource Conservation District to address the post-construction, long-term maintenance of the vegetated components of the channel.
The Cooperative Agreement between the City and the District stipulates the mechanism for the District to satisfactorily construct the Bedford Canyon Channel Stage 1 improvements and for the City to convey necessary rights-of-way such that the District can inspect, operate, maintain, and accept ownership of the channel. Execution of this Cooperative Agreement also provides the City consent to record an Irrevocable Offer of Dedication to the public for flood control and drainage purposes.
FINANCIAL IMPACT:
All costs associated with this action have been paid for by the applicant. Riverside County Flood Control and Water Conservation District is responsible for the construction costs for the storm drain channel facilities. The ongoing funding for the operation and maintenance of the storm drain channel will be the responsibility of the respective entity for each portion.
ENVIRONMENTAL ANALYSIS:
The action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This action merely approves a cooperative agreement between a private entity and public agencies for the future operation and maintenance of storm drain channel improvements. There is no possibility that approving this agreement will have a significant effect on the environment. Therefore, no environmental analysis is required.
