City Council consideration of releasing the Precise Grading and Erosion Control Securities associated with 4140 Temescal Canyon Road - Dos Lagos Office, LLC, a California Limited Liability Company.

RECOMMENDED ACTION:

Recommended action                     

That the City Council release the Precise Grading and Erosion Securities associated with 4140 Temescal Canyon Road (PWPR2018-0036 - R12487 and R12486).

 

Body

ANALYSIS:

On March 20, 2019, the City entered into a Grading Agreement with Dos Lagos Office, LLC, to secure the required grading, drainage, and erosion control associated with the construction of a 153,541 square-foot commercial office building on Parcel 1 of Parcel Map 34890 in the Business Park Zone of the Dos Lagos Specific Plan. The project is located on the west side of Temescal Canyon Road, north of Blue Springs Drive, as shown on Exhibit “A.”

 

All of the grading and drainage improvements secured by the agreement have been completed and inspected to ensure conformation with City specifications, and the site has been precise graded in accordance with all City Standards and the approved Grading Plan.  Therefore, it is appropriate to release the Precise Grading and Erosion Control Securities at this time.

FISCAL IMPACT:

All applicable fees have been paid by the developer.

 

ENVIRONMENTAL ANALYSIS:

This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment.  Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.  This action merely releases the current security associated with a ministerial permit.  Since there is no possibility that adopting this action will have a significant effect on the environment, no environmental analysis is required.
