EXECUTIVE SUMMARY:

This staff report asks the City Council to approve the Construction Agreement with RC Foster Corporation for the Well 17A Emergency Generator, Project No. 2021-43. Well 17A and the Ion Exchange Treatment Plant were identified in the 2021 Power Resiliency Risk and Needs Assessment as high-priority locations for an emergency generator. Both sites are equipped and prepared such that one generator can serve both sites simultaneously. This project will construct the required civil and electrical improvements at the Well 17A site for the pre-purchased equipment to be installed and placed into service and construct security fencing around Well 17A and an access path between the Well 17A and the Ion Exchange Treatment Plant sites.

 

RECOMMENDED ACTION:

Recommended action                     

That the City Council:

 

a.                     Approve the Construction Agreement with RC Foster Corporation for the Well 17A Emergency Generator, Project No. 2021-43 in the amount of $661,500.

 

b.                     Adopt the Plans and Specifications for the Well 17A Emergency Generator Project, Project No. 2021-43, Notice Inviting Bids 23-037CA.

 

c.                     Award Notice Inviting Bids 23-037CA to RC Foster Corporation, the lowest responsive, responsible bidder, for the total bid amount of $661,500 and waive any and all minor irregularities in the bidding documents as submitted by said bidder.

 

d.                     Authorize the City Manager, or his designee, to execute the Construction Contract with RC Foster Corporation in the amount of $661,500, including any non-substantive extensions, change orders, purchase orders, and amendments up to 10% or $66,150 as authorized in Corona Municipal Code Section 3.08.060(H).

 

e.                     Authorize an appropriation in the amount of $83,000 from the Water Utility Fund (570) to the Well 17A Emergency Generator Project 65311 for a total project cost of $880,000.

 

That the Corona Utility Authority review, ratify, and to the extent necessary, direct the City Council to take the above actions.

BACKGROUND & HISTORY:

The Community Power Resiliency Allocation Grant was awarded to the Utilities Department in March 2021 to complete a Power Resiliency Risk and Needs Assessment.  The grant had an unspent balance upon completion of the assessment, and the California Office of Emergency Services authorized the City to spend the funding on an additional eligible project. The Utilities Department received approval from City Council on October 20, 2021, to use the unspent balance toward the purchase of a generator, enclosure, diesel particulate filter, and fuel tank for Well 17A and the Ion Exchange Treatment Plant based on the preliminary results of the Power Resiliency Risk and Needs Assessment, which identified installation of an emergency generator at Well 17A and the Ion Exchange Treatment Plant as a high priority project. This project will construct the required civil and electrical improvements and install the pre-purchased equipment at the Well 17A site to serve both Well 17A and the Ion Exchange Treatment Plant.

 

ANALYSIS:

The Plans and Specifications for the Well 17A Emergency Generator Project were completed, reviewed, and approved by City staff. As specified in the bid package, the City shall award the contract for the project to the lowest responsive, responsible bidder as determined from the lowest total for the Bid Schedule.

 

This Project was advertised for bids on December 29, 2022, pursuant to Corona Municipal Code Section 3.08.110, Non-public projects formal bidding procedure and Public Contract Code requirements, to three (3) Pre-Qualified Contractors. On January 31, 2023, one (1) bid was received through the City's PlanetBids bidding service.

 

The following is a summary of the bid results and the Engineer's Estimate:

 

 

There are three prequalified contractors on the City’s list for Emergency Generator Projects, and this project is relatively small in scope, thereby limiting interest in bidding. The pre-purchased equipment for this project is scheduled for delivery to the City in April and in August 2023. Considering the deadlines for the grant funding used on this project and the delivery schedule of the pre-purchased equipment, staff recommends moving forward with the construction award for this project.

 

Staff has reviewed the bid and recommends awarding the contract to RC Foster Corporation (RC Foster) as the lowest responsive, responsible bidder based on the Bid Schedule for a total contract amount of $661,500. All licenses and references for RC Foster have been reviewed and verified by City staff, and all other documentation is in order.

 

City staff will administer the construction contract, and a contract consultant will perform inspection and construction management services. Should the City Council award the contract as recommended, construction is tentatively scheduled to commence in May 2023, with completion anticipated by December 2023.

 

FINANCIAL IMPACT:

Funding for the recommended actions and support services in the amount of $83,000 is requested to be appropriated from the Water Utility Fund 570 to the Well 17A Emergency Generator, Project No. 2021-43.

 

The estimated construction cost for this project is outlined as follows:

ENVIRONMENTAL ANALYSIS:

 This action is categorically exempt pursuant to Section 15301(f) of the Guidelines for the California Environmental Quality Act (CEQA), which states that minor alteration of an existing facility, for the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the CEQA determination.  This action involves the addition of safety or health protection devices for use in conjunction with existing facilities. Therefore, no environmental analysis is required, and staff will file a Notice of Exemption with the County of Riverside.
