EXECUTIVE SUMMARY:
This staff report asks the City Council to adopt Resolution No. 2023-061. Adoption of the recommended resolution will allow the City to levy and collect Fiscal Year 2024 special taxes. The Community Facilities District No. 2016-1 (Public Services) was formed in 2016 to finance the annual costs of police protection services (including but not limited to criminal justice services), fire protection and suppression services, and paramedic services.

Recommended action
That the City Council adopt Resolution No. 2023-061, levying special taxes to be collected during Fiscal Year 2024 for the payment of the annual cost of public services within Community Facilities District No. 2016-1 (Public Services).

BACKGROUND & HISTORY:
The Community Facilities District No. 2016-1 (Public Services) was formed in 2016 to finance the annual costs of police protection services (including but not limited to criminal justice services), fire protection and suppression services, and paramedic services within the District.
ANALYSIS:
It is necessary that the City Council levy special taxes for the payment of annual costs associated with police protection services (including but not limited to criminal justice services), fire protection and suppression services, and paramedic services, in the area of the Community Facilities District No. 2016-1 (the “District”), pursuant to Section 53340 of the Government Code. Special taxes within the District are levied in an amount necessary to satisfy the Special Tax Requirement, as defined in the District’s Rate and Method of Apportionment (the “RMA”). The special taxes levied will not exceed the authorized amounts as provided in the RMA.
FINANCIAL IMPACT:
The following is a summary of the Fiscal Year 2024 budgeted revenues and expenditures for the District:
The proposed Fiscal Year 2024 special tax rates for developed single-family residential and developed multi-family residential are $631.18 and $437.91 per residential unit, respectively. The recommended costs are necessary to provide police protection services, including but not limited to criminal justice services, fire protection and suppression services, and paramedic services within the District throughout Fiscal Year 2024.
ENVIRONMENTAL ANALYSIS:
This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the common sense exemption that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This action merely sets the special taxes to be levied and collected within the District for Fiscal Year 2024, and there is no possibility that adopting the resolution will have a significant effect on the environment. Therefore, no environmental analysis is required.
