Recommended action
That the City Council authorize the Mayor to execute Grading and Improvement Agreements for Tract Map 31373 between the City and Corona-Upper Drive 25, LLC, a Delaware Limited Liability Company.

ANALYSIS:
Tract Map 31373 is a subdivision of 18.10 acres into 26 single-family residential lots in the A-14.4 (Single Family Residential, 14,400 square foot minimum lot size) Zone and Estate Residential designation of the City’s General Plan and South Corona Community Facilities Plan. An existing single-family residence is located on Lot 26, one of the proposed lots. The tentative map was originally approved by the City Council on December 6, 2006, and the final map was approved by the City Council on July 18, 2018. The project is located on the east side of Lester Avenue, south of Upper Drive, as shown on Exhibit “A.”
On July 18, 2018, the City entered into Improvement and Survey Monumentation Agreements with Corona-Upper Drive 25, LLC, the current owner of the vacant property, to secure the street and utility public improvements, and survey monumentation required for the project.
The owner is now proposing to construct off-site improvements along Lester Avenue and Upper Drive contiguous to their project, consisting of asphalt, curb, gutter and sidewalk to the ultimate master-planned configuration. These improvements were not required as a condition of the map, however they are being constructed by the owner in cooperation with the adjacent property owner in order to enhance the project’s entry. The owner will enter into an Improvement Agreement with the City and post sufficient securities to guarantee construction of these public street improvements.
The site has been rough graded for the future 25 lots and the rough grading securities were released by City Council on February 6, 2019. In compliance with Grading Ordinance No. 2568, the owner will also enter into Grading Agreements to secure the precise grading operations, which include private drainage improvements, associated with a proposed temporary sales trailer on Lot 22, the model units on Lots 1 and 2, and the production units on Lots 3 through 25. A cash deposit has been posted to guarantee erosion control for precise grading phase. The grading design conforms to the Grading Ordinance and is consistent with sound engineering standards and practices. The elevation design minimizes significant height and slope differentials from surrounding properties, while maintaining the City’s obligation to protect the health and safety of citizens and property.

ENVIRONMENTAL ANALYSIS:
In accordance with Section 15063 of the State Guidelines for the California Environmental Quality Act (CEQA), the City prepared an initial study to determine if the project under Tentative Tract Map 31373 would have a significant effect on the environment. The initial study was prepared in accordance with Section 15063 and per the City's Local Guidelines for Implementing CEQA. The initial study identified environmental effects that were determined not to be significant and identified potentially significant effects that were capable of being mitigated to less than significant. Therefore, the City adopted a Mitigated Negative Declaration and Mitigation Monitoring Plan on December 6, 2006, in accordance with Section 15070 of the State CEQA Guidelines and Section 6.02 of the City's Local Guidelines for Implementing CEQA. However, this specific action before Council is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.
This action merely approves agreements that provide security to guarantee completion of improvements that are required in connection with a ministerial permit, and there is no possibility that approving these agreements will have a significant effect on the environment. Therefore, no environmental analysis is required.
