City Council consideration to execute the SB 132 Funding Agreement with Riverside County Transportation Commission for funding of the McKinley Street Grade Separation Project, No. 2012-12; authorize the City Manager, or his designees, to execute the Professional Services Agreement with Biggs Cardosa Associates, Inc. in the amount of $9,833,393; authorize the Purchasing Manager to issue a purchase order to Biggs Cardosa Associates, Inc. in the amount of $9,833,393; and award of RFP.

RECOMMENDED ACTION:
Recommended action
That the City Council:
1. Approve the Funding Agreement between Riverside County Transportation Commission and the City of Corona for funding of the McKinley Street Grade Separation.
2. Authorize the Mayor to execute the Funding Agreement between the Riverside County Transportation Commission and the City of Corona.
3. Increase revenue estimates in the amount of $84,450,000.00 in the Public Works Capital Grants Fund (Fund 243), and appropriate the same amount for McKinley Street Grade Separation Project (CIP 69370) in the same fund.
4. Award Request for Proposal (RFP) 18-046CA, titled “Environmental, Right-of-Way and Engineering Design Services for McKinley Street Grade Separation” to Biggs Cardosa Associates, Inc. for the total amount of $9,833,393, and waive any and all minor irregularities in the proposal.
5. Authorize the City Manager, or his designees, to execute the Professional Services Agreement with Biggs Cardosa Associates, Inc., for the total amount of $9,833,393.
6. Authorize the Purchasing Manager to issue a Purchase Order to Biggs Cardosa Associates, Inc. for the total amount of $9,833,393 for design services and approve necessary change orders and/or amendments up to the amount provided by the Corona Municipal Code Section 3.08.070(I).

ANALYSIS:
In 2006, the City of Corona and the Riverside County Transportation Commission (RCTC) worked collaboratively to successfully place the McKinley Street / BNSF Railroad Grade Separation Project in the top priority tier of at-grade railroad crossings in the Alameda Corridor East (ACE) of Riverside County. Projects placed in the top priority tier typically involve railroad crossings characterized by high train and vehicular traffic volumes, extensive vehicle delay and emissions, and have seen one or more traffic incidents in recent years.
In 2006, and again in 2008, RCTC developed a funding strategy to serve as a blueprint for constructing many of these at-grade railroad crossings. In March 2012, RCTC adopted the Grade Separation Priority Update Study for Alameda Corridor East (Riverside County), which placed the McKinley Street / BNSF Grade Separation Project in the No. 1 group of the top priority tier. In 2015, the City of Corona was notified that the McKinley Street / BNSF Railroad Grade was granted $2,400,000 for the design phase under Program Supplement Agreement NO28.
In March 2017, Senate Bill 132 (SB 132) funded the construction of the Riverside County Transportation Efficiency Corridor. The bill provided $84.45 million to McKinley Grade Separation as one out of five critical projects in Riverside County. With SB 132 funding comes a key schedule driver, the deadline to spend (encumber and liquidate) the allocated funding by June 30, 2023.
Improving mobility has been a challenge to Riverside County due to rapid population growth and the imbalance of jobs and housing. This has increased commuter traffic between the Inland Empire, Los Angeles and Orange Counties. The growth in goods movement has exacerbated traffic congestion as trucks compete with passenger vehicles for roadway space. The increase in warehousing and the growth in the flow of goods for truck and rail will further strain current transportation infrastructure in Riverside County. Recognizing the significant traffic congestion that Riverside County residents face every day, the State of California has dedicated the budget trailer bill, Senate Bill 132, in the amount of $427 million for the Riverside County Transportation Efficiency Corridor (RCTEC) payable from the State Highway Account, and State Transportation Fund to improve five (5) major transportation projects in Western Riverside County. The McKinley Street Grade Separation Project is one out of five awarded projects, and it received $84.45 million in funding. With an expenditure deadline of June 30, 2023, the State of California, Riverside County Transportation Commission, the County of Riverside, and other stakeholders are implementing new innovative strategies to accelerate completion of all five projects. De-obligation of the received federal funds accelerated project development to help meet the expenditure deadline by eliminating the need to address environmental clearance under National Environmental Policy Act (NEPA).
On April 25, 2018, Request for Proposals (RFP) 18-046CA titled “Environmental, Right-of-Way and Engineering Design Services for McKinley Street Grade Separation” was formally advertised in the Sentinel Weekly News and posted on the City of Corona website.
Three (3) proposals were received by the due date of May 23, 2018, and subsequently reviewed by a panel of professional engineers. The following is a summary of the proposal scoring results:
Proposals were received from Biggs Cardosa Associates, Inc., TYLIN International, and IDC Consulting Engineers, Inc. Staff reviewed the proposals, conducted interviews, ranked the firms based on experience and expertise, and recommends award to Biggs Cardosa Associates, Inc.
Biggs Cardosa Associates, Inc. (BCA) was selected as the top firm by the panel. It is believed that the BCA team possesses the skills and experience necessary to successfully execute the scope of work for the project. The Project Manager working with BCA has over twenty-eight years’ experience with extensive design and management experience in the preparation of Plans, Specifications and Estimates for grade separation and bridge design. In addition, BCA has completed over 100 grade separation and rail-related projects in California.

STRATEGIC PLAN:
This item supports the City’s Strategic Plan Goal 1: Promote Public Safety; Objective C: Ensure adequate funding for investments and improvements in infrastructure that support public safety. Completion of the proposed project will repair, replace, and install infrastructure improvements that contribute to the safety and mobility of Corona residents.

ENVIRONMENTAL ANALYSIS:
Grade separation projects are Statutorily Exempt under the California Environmental Quality Act (CEQA), and no environmental analysis or technical study are required. However, the City being a responsible steward to the community, is proposing to perform an environmental analysis outside of the requirements of CEQA as part of this design contract.
