City Council consideration to approve and authorize the City Manager to execute a Cooperative Agreement between the City of Corona, the Riverside County Flood Control and Water Conservation District, and Arantine Hills Holdings LP, a Delaware Limited Partnership, pertaining to the design, construction, inspection and acceptance for the ownership, operation and maintenance of the Bedford Canyon Line A, Line C, Line G, Line K, and Line C - Stage 2 storm drain facilities associated with Tract Nos. 36294 and 37030.

RECOMMENDED ACTION:
Recommended action
That the City Council approve and authorize the City Manager to execute the Cooperative Agreement between the City of Corona, the Riverside County Flood Control and Water Conservation District (“District”) and Arantine Hills Holdings LP, a Delaware Limited Partnership (“Developer”) pertaining to the design, construction, inspection, and acceptance for the ownership, operation and maintenance of the Bedford Canyon Line A, Line C, Line G, Line K, and Line C - Stage 2 storm drain facilities associated with Tract Nos. 36294 and 37030.

ANALYSIS:
Arantine Hills Holdings LP (“Developer”), is constructing certain flood control facilities in order to provide flood control protection and drainage for the development of Tract Nos. 36294 and 37030 in the City of Corona. The Developer has entered into Right of Entry and Inspection Agreements with the Riverside County Flood Control and Water Conservation District (“District”) which has allowed construction to commence on the Line A, Line C, Line G, Line K, and Line G- Stage 2 underground storm drain facilities. It is the intent of the Developer that the District accept ownership and responsibility for the operation and maintenance of these underground storm drain facilities. Associated with these facilities are catch basins, inlets, curbs and gutters, connector pipes and storm drain laterals 36 inches or less in diameter within City held easements or right-of-way. It is the intent of the Developer that the City accept ownership and responsibility for the operation and maintenance of these appurtenances. Additional storm drain improvements associated with Tract Nos. 36294 and 37030 will be owned and maintained by the Developer and subsequently by the Home Owner’s Association.
The Cooperative Agreement stipulates the mechanism for the Developer to satisfactorily construct and convey necessary rights-of-way such that the District can inspect, operate and maintain, and accept ownership of the District facilities located within the City’s right-of-way.

FISCAL IMPACT:
The Developer is responsible for the costs to construct the storm drain facilities. Funding for operation and maintenance of the appurtenant storm drain facilities located within the City right-of-way that will not be operated and maintained by the District or the Developer will be included in the project’s Community Facilities District (CFD), 2018-1, tax “B” assessments. The City will include these costs in the operational budget for this CFD at the time the City accepts such improvements.
ENVIRONMENTAL ANALYSIS:
This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This action merely approves an agreement to provide future operation and maintenance on constructed improvements that are required in connection with a ministerial permit, and there is no possibility that approving this agreement will have a significant effect on the environment. Therefore, no environmental analysis is required.
