RECOMMENDED ACTION:

Recommended action                     

That the:

 

1.                     City Council authorize the General Manager to execute the amendment No. 1 to the agreement to form the Middle Santa Ana River Watershed Total Maximum Daily Load Task Force.

 

2.                     Corona Utility Authority (CUA) review, ratify and to the extent necessary direct that the City Council take the above action.

ANALYSIS:

The Middle Santa Ana River Total Maximum Daily Load (TMDL) was adopted by the Santa Ana Regional Water Quality Control Board on August 26, 2005, by Resolution R8-2005-0001, naming the Santa Ana River Reach 3 as one of the impaired water bodies for pathogen indicators.  The TMDL identifies the City of Corona as one of the dischargers who must comply with TMDL requirements, including pathogen indicator waste load allocations for urban discharges and specific compliance schedules.  The Middle Santa Ana River Watershed TMDL Task Force agreement establishes a task force to cooperatively complete watershed-wide tasks and undertake all other plans, programs, and studies as authorized by the parties to the agreement in order to comply with the TMDL.  The agreement establishes the responsibilities and cost sharing criteria among the parties.

Withdrawal from, or non-participation in the agreement will require the City of Corona to separately comply with all requirements established for urban dischargers in the Middle Santa Ana River.  

On May 16, 2007, the City of Corona entered into the original agreement to form the Middle Santa Ana River TMDL Task Force.  The term of this agreement was five years and expired on November 30, 2012. An amendment was signed on January 2013 by City of Corona to extend the agreement until December 31, 2017.  A new agreement has been prepared by the Santa Ana Watershed Project Authority to extend the term of the Task Force for five years, to December 31, 2022.

FISCAL IMPACT:

The cost share for the City of Corona for Fiscal Year 2018-19 is $14,018.00. This cost share has been appropriated in the Fiscal Year 2018-19 operating budget through the City’s share of County Service Area Assessment, or CSA 152 (NPDES Fund 245).

The pro rata cost share for the City of Corona for the following four (4) fiscal years shall be approximately $15,000.00 annually, which will be requested in advance to the Santa Ana Watershed Project Authority to be included into the following year zero-based budget request.

 

ENVIRONMENTAL ANALYSIS:

No environmental review is required because the proposed action is not a project governed by the California Environmental Quality Act.
