RECOMMENDED ACTION:

Recommended action

That the City Council adopt Resolution No. 2019-078 attesting to the veracity of the data contained in the 2018 Power Source Disclosure Program Annual Report and associated Power Content Label for years ending December 31, 2018.

Body

ANALYSIS:

Senate Bill 1305, as amended by Assembly Bill 162, requires retail suppliers of electricity to disclose its sources of energy being used to the California Energy Commission (CEC) and to consumers in the form of the Power Source Disclosure Annual Report and the Power Content Label.  The intent of the Power Content Label is to provide consumers with accurate, reliable, and simple-to-understand information on the sources of energy being used.

As a requirement of Assembly Bill 162, the information contained within the Power Source Disclosure Program Report and the Power Content Label must be validated through an independent or thirty-party audit.  The Administrative Manager of the Department of Water and Power (DWP), an authorized agent of DWP, may submit to the CEC, under penalty of perjury, an attestation confirming the accuracy of the report.  The City Council, at a public meeting, must approve the submission of such attestation.

The 2018 Power Source Disclosure Program Report and the Power Content Label has been submitted to the CEC. In addition to posting the Power Content Label on the City’s website, it is also included as an exhibit to Resolution No. 2019-078 along with the Power Source Disclosure Program Report.
