RECOMMENDED ACTION:

Recommended action                     

That the City Council:

 

1.                     Adopt the Plans and Specifications for the ADA Improvements at Various Park Restrooms- Year 1 Project

 

2.                     Award Notice Inviting Bid (“NIB”) 20-021CA for ADA Improvements at Various Park Restrooms - Year 1 to Next Stage Engineering dba Next Stage Engineering & Construction of Fresno, CA, in the amount of $139,860.00.

 

3.                     Authorize the Public Works (“PW”) Director to execute a contract with Next Stage Engineering dba Next Stage Engineering & Construction in the amount of $139,860.00 and approve necessary change orders up to twenty percent of the contract.

 

4.                     Authorize the PW Director and City Attorney to negotiate and execute any amendments to these agreements which are either non-substantive or otherwise in compliance with the City Council’s actions hereunder.

 

5.                     Authorize the Purchasing Agent to issue a purchase order in the amount of $139,860.00 in accordance with duly authorized and executed agreements.

 

Body

ANALYSIS:

In 1990, the United States Congress passed the first Americans with Disabilities Act (ADA). The ADA was the first civil rights law that was created to address the needs of people with disabilities by prohibiting discrimination in employment, public services, public accommodations, and telecommunications. The law consists of five titles that address different areas: Title 1 - Employment, Title II - Public Services, Title III - Public Accommodations, Title IV - Telecommunications, and Title V - Miscellaneous Provisions. In 1991 the first regulations were issued and became effective in 1992. ADA mandates reasonable accommodation for individuals with disabilities to ensure they have the same opportunities and access to programs and facilities as those without disabilities.

The City of Corona is primarily responsible for compliance with Title II standards. Both the Federal government and the State of California have issued and amended Title II standards over the years that set building and public facility requirements for accessibility. These standards include requirements the display of appropriate signage, accessible stalls within parking lots, accessible routes to and surfacing under playgrounds and amenities, and fixture heights, specific hardware and clearances to ensure access to public restrooms. Due to the high cost of implementing many of these standards, the City created a transition plan and timeline to accomplish these mandates.

Corona owns and maintains 36 park sites covering 367 acres of parkland. The City’s oldest park, City Park, has been in existence for over 100 years, but the majority of the City’s parks were built between the 1980s and the early 2000s. A recent ADA lawsuit alleging non-compliance at many of the City’s parks was settled with an agreement to make various ADA improvements at 33 City parks over a five-year period. Since entering into the settlement agreement, the City began the engineering and design of improvements at the parks designated for first year changes: Citrus Park, Promenade Park, Mountain Gate Park, and Santana Park.

The proposed project is for improvements by the settlement to the six restrooms at the referenced parks. Improvements generally consist of modifying clearances by installing new bathroom partitions, replacing existing signage at the appropriate location and height, removing and replacing sinks with a standardized model with appropriate faucet run-times and pipe insulation, removal of fixtures such as soap dispensers and mirrors, and removal and replacement of fixtures such as hand rails, door hardware, toilet paper dispensers and door closers with compliant equipment. All restrooms walls will be patched and repainted.

The Plans and Specifications for this project were completed by NV5 and reviewed by staff and are ready for adoption and award.  The Public Works Department issued NIB 20-021CA for this project. The bid was posted for the project on the City’s PlanetBids bidding website on October 19, 2019 and advertised in the Sentinel Weekly on October 16, 2019. Seven bids were received by the November 5, 2019 due date and time. The results of the bids are as follows:

Next Stage Engineering & Construction of Fresno, CA is the apparent low bidder, with a bid submission of $139,860.00. PW recommends that the City Council award the project to Next Stage Engineering & Construction of Fresno, CA in the amount of $139,860.00.

 

COMMITTEE ACTION:

This Project was presented to the Parks and Recreation Commission on May 8, 2019 and the Public Services Committee on June 5, 2019 and was approved to proceed.

 

STRATEGIC PLAN:

This item supports the City’s Strategic Plan Goal 1:  Promote Public Safety:  Protect our Residents and Businesses; Objective C:  Ensure adequate funding for investments and improvement in infrastructure that support public safety. The recommended action will help achieve these goals by providing funding to upgrade existing City park restrooms in order to be compliant with Americans with Disabilities Act (“ADA”) standards.

 

FISCAL IMPACT:

There is currently a Capital Improvement Project (“CIP”) for this project, No. 68690 for Citywide Improvements. CIP 68690 has a current balance of $2,284,682.35 and is sufficient for awarding of NIB 20-021CA

 

ENVIRONMENTAL ANALYSIS:

This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This action merely authorizes City staff to have a contractor make minor modifications and improvements to existing restroom buildings in order to achieve ADA compliance, and there is no possibility that approving this action will have a significant effect on the environment. Therefore, no environmental analysis is required, and staff will file a Notice of Exemption with the County of Riverside.
