City Council consideration of approving the 2021-2023 City of Corona Transit Service (CCTS) Title VI Program in compliance with the Federal Transit Administration (FTA)/Civil Rights Act of 1964.

RECOMMENDED ACTION:

Recommended action                     

That the City Council approve the 2021-2023 City of Corona Transit Service Title VI Program in accordance with Federal Transit Administration Circular 4702.1B.

 

Body

ANALYSIS:

The CCTS has updated its 2021-2023 Title VI Program Report in compliance with Title 49 of the Code of Federal Regulations (CFR) Section 21.9(b), and the FTA,  which require recipients to prepare and submit an FTA Title VI Program update once every three (3) years.  The City Council last approved the Title VI program on August 2, 2018.

 

Title VI of the Civil Rights Act of 1964 provides that “no person in the United States shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance.”

 

Pursuant to FTA Circular 4702.1B - Title VI Guidelines for FTA Recipients, the program report must include the following information:

 

1.                     A summary of public outreach and involvement activities undertaken since the last submission, and a description of steps taken to ensure that minority and low-income people had meaningful access to these activities.

 

2.                     A copy of the agency’s plan for providing language assistance to persons with limited English proficiency, based on the Department of Transportation (DOT) Limited English Proficiency (LEP) Guidance.

 

3.                     CCTS compliant procedures and guidelines for filing Title VI complaints (Appendix A of the Title VI Program).

 

4.                     A list of any Title VI investigations, complaints, or lawsuits filed with the agency since the time of the last submission. 

 

5.                     A copy of the agency’s notice to the public that the agency complies with Title VI, and instructions to the public on how to file a discrimination complaint (Figure 2; pg. 9 of Title VI Program).

 

6.                     Information regarding the racial breakdown of transit-related policy boards or committees.

 

7.                     An equity analysis if the recipient has constructed a facility (such as a garage, maintenance facility, or operation center) using FTA funds since the last Title VI program update.

 

8.                     A copy of board meeting minutes or other appropriate documentation showing the Board of Directors, or appropriate governing entity or official(s) responsible for policy decisions reviewed and approved the Title VI Program.

 

9.                     System-wide standards and policies that address:

a.                     Vehicle load

b.                     Vehicle headway

c.                     On-time performance

d.                     Service availability

 

10.                     Service policies that address:

a.                     Provision of transit amenities

b.                     Vehicle assignment

 

These requirements and guidelines apply to all FTA recipients.  FTA is responsible for ensuring that its recipients fully comply with Title VI of the Civil Rights Act of 1964.

STRATEGIC PLAN:

This item supports the City’s Strategic Plan Goal 4: Actively engage in public and private partnerships to provide services and amenities; Objective A: Proactively develop partnerships with local and regional business interest and agencies by participating in community events and sharing information regarding CCTS.

 

 

FISCAL IMPACT:

There is no fiscal impact to the General Fund.  Approval of the CCTS 2021-2023 Title VI Program is needed for continued eligibility for federal assistance to support current and future capital projects and operating costs by demonstrating compliance with Title VI of the Civil Rights Act of 1964 administered by FTA under Title 49 of the Code of Federal Regulations (CFR) Section 21.9(b).

 

ENVIRONMENTAL ANALYSIS:

This action is exempt from the California Environmental Quality Act (CEQA).
