EXECUTIVE SUMMARY:

Riverside County Transportation Commission (RCTC) acquired land on behalf of the City of Corona in 2014 for improvements associated with the Foothill Parkway Westerly Extension Project, generally located along Foothill Parkway, east of Paseo Grande and west of Trudy Way. The proposed action will accept the grant deed from RCTC for approximately 20.67 acres of real property and 17.84 acres of slope easements and authorize the City Attorney to execute the Certificate of Acceptance.

 

RECOMMENDED ACTION:

Recommended action                     

That the City Council:

 

a.                     Accept the grant deed of approximately 20.67 acres of real property and 17.84 acres of slope easements associated with the Foothill Parkway Westerly Extension Project from Riverside County Transportation Commission, a Public Agency of the State of California.

 

b.                     Authorize the City Attorney to execute the Certificate of Acceptance.

BACKGROUND & HISTORY:

The Foothill Parkway Westerly Extension Project (“Project”) is located within the southwesterly limits of the City of Corona and in the unincorporated area of Riverside County within the City’s sphere of influence, along the base of the Santa Ana Mountains and involved the extension of Foothill Parkway, from approximately 600 feet west of Skyline Drive to Green River Road.

 

On September 16, 2009, the City Council authorized an amendment to the Traffic Uniform Mitigation Fee (TUMF) Funding Agreement, which facilitated the acquisition of specific parcels of property by the Riverside County Transportation Commission (RCTC) for the Project. A final order of condemnation was given for these properties in 2014, which included the acquisition of parcels in fee, slope easements, and temporary construction easements generally located along Foothill Parkway, east of Paseo Grande and west of Trudy Way.  A Notice of Completion for the Project was approved by City Council on June 21, 2017, following the completion of the construction.

 

ANALYSIS:

The right-of-way acquisitions have been completed per the TUMF Funding Agreement and are ready for transfer to the City. Representatives of the Riverside County Transportation Commission contacted Public Works in November 2020 and worked with City staff to finalize a grant deed that conveys the interest of the parcels and slope easements to the City of Corona. Temporary construction easements originally part of the property acquisition have expired and are therefore excluded or struck from the grant deed. The acquisitions contain Foothill Parkway improvements, which are operated and maintained by the City. They include areas of street, parkway, slopes, and adjacent drainage facilities, as shown in Exhibit “1.” Conveying the property to the City ultimately gives the City full control in future actions associated with the parcels and slope easements.

 

FINANCIAL IMPACT:

The costs associated with the acquisition of the property, including right-of-way engineering, appraisal, acquisition, consultant, expert, legal costs for condemnation procedures, and costs of reviewing appraisals and offers for property acquisition, were paid for through the TUMF funding agreement.

 

ENVIRONMENTAL ANALYSIS:

An Environmental Impact Report for this project was adopted by City Council on February 4, 2009, pursuant to the California Environmental Quality Act.
