EXECUTIVE SUMMARY:
This action is to approve the Amended and Restated Funding Agreement with Riverside County Flood Control and Water Conservation District to fund 50 percent of the design and 75 percent of the construction for the Western Riverside County Regional Wastewater Authority Reclaimed Waterline. This action is also to approve the award of Notice Inviting Bids No. 22-082CA for the Western Riverside County Regional Wastewater Authority Reclaimed Waterline, Project No. 2017-21 to Ferreira Coastal Construction Company for the total bid amount of $4,595,370. The project will construct a new reclaimed waterline in River Road from the Western Riverside County Regional Wastewater Authority Wastewater Treatment Plant, in the City of Eastvale, to an existing City of Corona 20-inch reclaimed waterline located at the intersection of River Road and Bluff Street in the City of Norco.

Recommended action
That the:
a. City Council approve the Amended and Restated Funding Agreement with Riverside County Flood Control and Water Conservation District to fund 50 percent of the design and 75 percent of the construction for the Western Riverside County Regional Wastewater Authority Reclaimed Waterline, Project No. 2017-21.
b. City Council authorize the City Manager, or his designee, to execute the Amended and Restated Funding Agreement with Riverside County Flood Control and Water Conservation District to fund 50 percent of the design and 75 percent of the construction for the Western Riverside County Regional Wastewater Authority Reclaimed Waterline, Project No. 2017-21.
c. City Council authorize an appropriation and an offsetting estimated revenue increase in the amount of $929,000 from the Water Utility Grant/Agreement Fund (571) for the Western Riverside County Regional Wastewater Authority Reclaimed Waterline, Project No. 2017-21.
d. City Council adopt the plans and specifications for the Western Riverside County Regional Wastewater Authority Reclaimed Waterline, Project No. 2017-21, Notice Inviting Bids 22-082CA.
e. City Council award Notice Inviting Bids 22-082CA to Ferreira Coastal Construction Company, the lowest responsive, responsible bidder, for the total bid amount of $4,595,370 and waive any and all minor irregularities in the bidding documents as submitted by said bidder.
f. City Council authorize the City Manager, or his designee, to execute the contract with Ferreira Coastal Construction Company in the amount of $4,595,370.
g. City Council authorize the City Manager, or his designee, to negotiate and execute non-substantive extensions, change orders, and amendments up to 10% of the construction contract value, which is equivalent to $459,537.
h. City Council authorize the Purchasing Manager to issue a Purchase Order to Ferreira Coastal Construction Company in the amount of $4,595,370 for construction services.
i. Corona Utility Authority review, ratify, and to the extent necessary, direct the City Council to take the above actions

BACKGROUND & HISTORY:
On January 18, 2017, the City Council approved a Funding Agreement (Original Agreement) with the Riverside County Flood Control and Water Conservation District (District) to fund the design and construction for the Western Riverside County Regional Wastewater Authority (WRCRWA) Reclaimed Waterline. The project location and limits are shown on Exhibit 1. The Original Agreement, included as Exhibit No. 2, committed the District to fund 50 percent of the design and construction up to a maximum of $1,500,000. The District funds water conservation projects and wishes to support the City’s effort to augment water supplies by supporting the development of the City’s reclaimed water system.
The project construction was delayed for a few years due to design changes and a lengthy environmental process to meet California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) requirements. The engineering construction cost estimate for the project has been updated to reflect current construction prices and shows the District’s contribution of 50% of the project costs, which were identified in the Original Agreement, will exceed the maximum contribution amount of $1,500,000. The current construction cost estimate for the project is $5,200,000, and the design cost is $143,500. Staff contacted the District to request additional funding, and the District agreed to work collaboratively with the City to keep progressing with the project by allocating and appropriating additional funds for design and construction costs. The recommended Amended and Restated Funding Agreement, included as Exhibit No. 3, between the District and the City commits the District to increase it’s funding for the project from $1,500,000 to a maximum of $4,231,781.
The Project will include construction of approximately 3,900 linear feet of new 20-inch ductile iron reclaimed waterline and 100 linear feet of new 12-inch Polyvinyl Chloride (PVC) reclaimed waterline, including all necessary connections, hydrant blow-off assemblies, valves, asphalt, and concrete pavement restoration, and related work. The Project will be constructed in River Road from the WRCRWA Wastewater Treatment Plant, in the City of Eastvale, to an existing City 20-inch reclaimed waterline located at the intersection of River Road and Bluff Street in the City of Norco.
ANALYSIS:
Approval of the recommended Amended and Restated Funding Agreement will provide additional funding for the design and construction of the Project. The Amended and Restated Funding Agreement commits the District to fund 50 percent of the design and 75 percent of the construction up to a maximum of $4,231,781.
In addition to the District’s contribution, under Title XVI - Water Reclamation and Reuse Program (Title XVI Program), the City has received a commitment for funding from the Bureau of Reclamation for 25 percent, up to a maximum of $3,880,000, of the design and construction costs of the Project, included as Exhibit 4. Through the Title XVI Program, the Bureau of Reclamation identifies and investigates opportunities to reclaim and reuse wastewater and impaired ground and surface water in the 17 Western States and Hawaii. The Title XVI Program includes funding for the planning, design, and construction of water recycling and reuse projects in partnership with local government entities.
The City contributed 25 percent of the design costs for the Project and will contribute funding for any costs not covered by either the District or Title XVI funding programs with funding from the Reclaimed Water Utility Fund (567).
The plans for the project were completed by KWC Engineers and were reviewed and approved by City staff. The specifications for the project were prepared by City staff. The project was advertised for bids on June 16, 2022, to eleven (11) Pre-Qualified Contractors, pursuant to Corona Municipal Code Section 3.08.090 and the State’s Public Projects - Formal Bidding Procedure and Public Contract Code requirements. On August 11, 2022, two (2) bids were received through the PlanetBids bidding service.
The following is a summary of the bid results and Engineer’s Estimate:
Staff reviewed all bids and recommends awarding the contract to Ferreira Coastal Construction Company as the lowest responsive, responsible bidder based on the Bid Schedule for a total contract amount of $4,595,370. All licenses and references for Ferreira Coastal Construction Company have been reviewed and verified by City staff, and all other documentation is in order.
Should the City Council award the contract and approve the Amended and Restated Funding Agreement as recommended, construction for this project is tentatively scheduled to commence in November 2022, with completion anticipated by June 2023. The tentative project completion date may change due to ongoing material shortages.
Staff will seek construction management and inspection services for this project and the Well 22 Piping and Site Improvements, which are to be presented for consideration at a future City Council meeting. Staff will benefit from having additional help to allow other projects to be worked on concurrently. The Well 22 Piping and Site Improvements was advertised for bids on August 4, 2022. Bids are due on September 6, 2022. In addition to construction management and inspection services, the scope of work will include soils and materials testing. Using one consultant to manage the two projects concurrently will simplify construction management and inspection services and encourage lower cost and better service.
FINANCIAL IMPACT:
Approval of the recommended actions will result in an appropriation and an offsetting estimated revenue increase in the amount of $929,000 from the Water Utility Grant/Agreement Fund (571) to the WRCRWA Reclaimed Waterline Project No. 69711. The remaining funding for the recommended actions is available in the Fiscal Year 2023 Capital Improvement Project Budget in the WRCRWA Reclaimed Waterline Project numbers 69710 and 69711 within the Reclaimed Water Utility Fund (567) and Water Utility Grant/Agreement Fund (571).

ENVIRONMENTAL ANALYSIS:
On September 7, 2016, the City Council adopted Resolution No. 2016-091, included as Exhibit 5, approving an Initial Study and Mitigated Negative Declaration (IS & MND) for Proposition 1 - Reclaimed Water Distribution Facilities Project. Proposition 1 - Reclaimed Water Distribution Facilities Project is the expansion of the City’s reclaimed water system, which includes the construction of two water storage tanks and the construction of 16 new pipeline projects, including the WRCRWA Reclaimed Waterline. These projects will enable the City to more efficiently operate the reclaimed water system by providing additional water storage capabilities and additional sources of reclaimed water to irrigate existing landscaping with reclaimed water offsetting the use of potable water.
On May 2, 2018, City Council adopted Resolution No. 2018-024, included as Exhibit 6, approving Addendums No. 1 and No. 2 to the 2016 IS & MND for Proposition 1 - Reclaimed Water Distribution Facilities Project and making environmental facts and findings pursuant to the CEQA. Addendum No. 1 addressed the change in waterline size from 16-inch to 20-inch diameter for the Project to meet the anticipated demand for reclaimed water. Addendum No. 2 proposed a new alignment of the waterline for the Project where 2,000 feet of waterline would be installed within the Riverview Recreation Park within an easement across the Department of Army Corps of Engineers federal lands. This change reduced the length of the proposed reclaimed waterline and thus reduced project cost. The Department of the Army Corps of Engineers granted the City an easement for a 25-year term, beginning February 9, 2018, and ending February 8, 2043. As part of being granted this easement, the NEPA required an Environmental Assessment (EA) to be prepared for the Project. The EA for the Project was completed in December 2017, satisfying the NEPA requirements. City staff reviewed the changes to the Project and determined that upsizing of the waterline and change of alignment did not require the preparation of a subsequent IS & MND. The two addenda were prepared in accordance with Section 15164 of the State CEQA Statue and Guidelines, and Section 6.18 of the City’s Local CEQA Guidelines.
On May 5, 2021, City Council adopted Resolution No. 2021-005, included as Exhibit 7, certifying the Final Program Environmental Impact Report (PEIR) prepared for the 2018 Reclaimed Water Master Plan (2018 RWMP) and adopting Environmental Findings of Fact and a Mitigation Monitoring and Reporting Program (MMRP) pursuant to the CEQA. The City also adopted Resolution 2021-006, included as Exhibit 8, approving the 2018 RWMP. The 2018 RWMP identified the WRCRWA Wastewater Treatment Plant, in the City of Eastvale, as a future source of reclaimed water for the City. WRCRWA is a joint powers authority consisting of the City of Norco, City of Corona, Jurupa Community Services District, Home Gardens Sanitary District, and Western Municipal Water District. The WRCRWA Wastewater Treatment Plant, located at 14634 River Road in the City of Eastvale, provides wastewater treatment services to its member agencies and treats wastewater at a tertiary level improving the wastewater quality before it is discharged into the Santa Ana River. Per the 2018 RWMP, the Project is one of six projects to support and facilitate the transmission and distribution of reclaimed water from the WRCRWA Wastewater Treatment Plant to the City. The environmental documents concluded that all environmental impacts for the project are either insignificant or can be mitigated to a level of insignificance.
