EXECUTIVE SUMMARY:
This staff report asks the City Council to approve the Professional Services Agreement with JMDiaz Inc. in the amount of $235,861 for the design and engineering services for the Radio Road At-Grade Railway Crossing Safety Improvement, Project No. 2022-09. The project will install raised median islands on both approaches, install pedestrian sidewalk treatments, curb and gutter, accessible curb ramps, signing and striping, street lighting, and relocate existing utilities. The cost of design and construction is fully reimbursable as the project is funded by the United States Code Section 130 Grade Crossing Improvement Program.
RECOMMENDED ACTION:
Recommended action
That the City Council:
a. Award Request for Proposal 23-023AS for design and engineering services for the Radio Road At-Grade Railway Crossing Safety Improvement Project, No. 2022-09, to JMDiaz Inc. of Industry, CA.
b. Approve the Professional Services Agreement with JMDiaz Inc. for the design and engineering services, for a term of two years beginning May 17, 2023, through May 21, 2025, in the amount of $235,861.
c. Authorize the City Manager, or his designee, to execute a Professional Services Agreement with JMDiaz Inc. in the amount of $235,861, including any non-substantive extensions, change orders, purchase orders, and amendments up to $23,586 or 10% of the total contract amount as authorized in Corona Municipal Code Section 3.08.070(I).

BACKGROUND & HISTORY:
The City of Corona has been awarded funding for a Section 130 Highway Rail at-grade crossing safety improvement project at the Radio Road grade crossing. The Section 130 program is a federally funded program administered by the States for the elimination of hazards at highway-rail at-grade crossings. This location was identified as a candidate location via a data-driven methodology which includes but is not limited to train and vehicle volumes, geometric factors, pedestrians, buses, hazmat vehicles, and incident history.
The purpose of the project is to improve the safety at the Radio Road crossing by mitigating existing potential hazards to reduce the chance of future incidents. At Radio Road, potential hazards identified include:
• The possibility of vehicles driving around lowered gate arms.
• The lack of separated pedestrian pathways.
• Clear delineation of vehicle, bicycle, and pedestrian pathways on approach and through the crossing.
The use of federal funding also requires addressing pedestrian and bicycle pathways. Currently, pedestrians and bicyclists share the roadway to cross the tracks. At this location, it has been identified that safety would benefit by providing a separate sidewalk on one or both sides of the crossing and installing curb and gutter where applicable to separate the types of movements. The sidewalk will link to existing sidewalk facilities located on both sides of the crossing. Pedestrian pathway treatments may differ across the bridge structure (such as raised curb or striping) to delineate a pedestrian pathway and the vehicular lanes. Providing these pathways will provide a safer crossing pathway for pedestrians. As part of installing sidewalk, several utility poles will need to be relocated to provide required Americans with Disabilities Act access.
ANALYSIS:
The Purchasing Division issued RFP 23-023AS for design and engineering services for this project on February 7, 2023, pursuant to CMC 3.08.110. The City notified 382 vendors about the RFP. The closing date was March 15, 2023, and the City received a total of three proposals. The following is a summary of the proposal evaluation results:
Based on the proposal evaluation analysis, JMDiaz’s team possesses the skills, experience, and staffing necessary to successfully execute the scope of work for this project. The project manager proposed for this project has successfully completed projects of similar nature, size, and complexity and will be supported by internal staff and by specialty firms with a similar record of success and experience. Staff recommends awarding the contract to JMDiaz Inc.
FINANCIAL IMPACT:
There is no financial impact for these actions as the Radio Road At-Grade Railway Crossing Safety Improvements Project is fully reimbursable through Federal Section 130 Grade Crossing Safety Improvement Program. On June 1, 2022, City Council accepted the Grant and approved an appropriation and estimated revenue increase within the Public Works Grants/Agreements Fund 243.
ENVIRONMENTAL ANALYSIS:
These actions are exempt from the California Environmental Quality Action (CEQA), as the actions are not a “project” as defined by CEQA (PRC Section 21065 and CEQA Guidelines Section 15378), guidelines which define a “project” as the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or reasonable foreseeable indirect physical change in the environment, and that is an activity directly undertaken by any public agency including public works construction and related activities. These actions involve the approval of a professional services agreement for design and engineering services. Therefore, no environmental analysis is required at this time. After approval of the recommended actions herein, staff will proceed with the design and environmental document phase of this project. Any applicable documentation will be prepared and filed at that time.
